By submitting your source materials (Content) to Picture Show Ltd you agree to all the agreements and policies below:
Personal Picture Stories
It is your responsibility to provide Picture Show Ltd with all photographs and video footage to be used. You certify that you are the owner of the materials submitted to Picture Show Ltd for processing, or that you have obtained written permission from the copyright owner to use them. Picture Show can use any song(s) you request by either purchasing them on your behalf from iTunes (included in your package price) or by having you send the CD that contains the song directly to us. Because these songs are purchased legally and for your personal use, we are abiding by FAIR USE Act Provisions (2007).
The finished picture show is for your personal use only. Presentations that contains copyright protected music are not permitted to be broadcast, on-sold or displayed on websites or social media platforms. You agree to protect and indemnify Picture Show Ltd (and its assignees) from any costs related to copyright or intellectual property infringement.
Limitation of Liability
Picture Show Ltd will make every effort to care for and protect your Content from damage or loss. You expressly understand and agree that Picture Show Ltd will not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages to, theft or loss of the content you provide, damage to electronic equipment, loss of profits, goodwill, use, data or other intangible losses, resulting from, but not limited to, product defects, accident, misuse, acts of God or other foreseeable or unforeseen circumstances.
You accept that Picture Show Ltd is not liable for photographs which are supplied dirty, damaged, twisted, deformed, water damaged or deteriorated beyond recovery. We will advise you if we feel the photograph is not suitable for use.
Picture Show Ltd respects the privacy of our customers and we incorporate the requirements set out in the Privacy Act 1993. We do not sell, share, or distribute your personal information or your content without your express written permission, other than as required by law. The Privacy Act is supervised by the New Zealand Privacy Commissioner.
